What is a short sale?
A Short Sale is a sale of a property where the lender agrees to accept less than what is owed to pay off the loan. In a Short Sale situation the owner owes more on the property than they can sell the home for on the open market. The Owner can request that the bank allow them to sell the property to the highest offer and forgive the difference between the amount received and the amount owed. Not all Short Sale scenarios allow the Seller to be "forgiven" the difference between sale price and what was owed on the property. Please consult with a tax consultant to find out the correct answer for your situation as you may have a tax consequence for the difference or be asked to sign a Note to repay the difference. This is a viable option for many Sellers and Banks as it is a less expensive option for the Bank than to take the property through foreclosure.

Short Sale properties are typically sold in “as-is” condition, similar to purchasing an REO property. It is ALWAYS our recommendation that you hire an independent inspection of the property when purchasing any home. Selling “as-is” is most often due to the Seller’s inability to afford repairs. As a Buyer of a Short Sale, you can expect a sometimes lengthy process in obtaining a Bank’s approval of your offer.

Who can qualify to sell their house as a short sale?
A home owner who has a mortgage on their home and owe more than the home is worth may decide to sell their home as a short sale. The lenders will look at the sellers circumstances and any hardship they may have encountered since obtaining the loan. This hardship can be illness, divorce, loss of a job, reduction of income, mortgage rate adjustment etc. The seller will have to submit a hardship letter to the lender along with complete financial statements and short sale package. The seller will have to prove hardship to the lender.

It is everyone’s goal to keep you in your home whenever possible. It’s important to talk to your lender to try to work out a solution
to keep you in your home. If that process fails and a Short Sale can be your next option. A Short Sale is typically less detrimental to your credit in the long term.

Why Use A Buyer's Agent?

I am often asked, "Why do I need a Buyer's Agent? Isn't it easier just to call the name on the sign?" Two really good questions. Let me help explain why representation is to your advantage. A Buyer's Agent works exclusively for you. They provide you with:

Loyalty - Your real estate agent acts in your best interests.

Obedience - Your real estate agent must follow all of your lawful instructions.

Disclosure of Material Facts and Material Defects - Your agent must disclose to you all material facts of the property.

Examples include but are not limited to:

Relationships between the agents and other parties
Existence of other offers or counter-offers
Status of earnest money deposit
Seller’s ability or lack of ability to close the transaction
Property’s market value
Impact of important contract provisions

Confidentiality - The real estate agent must keep your confidences. Any information which you reveal to the agent about your motivation to purchase, your time requirements, or any other information which would put the seller at an advantage over you must remain confidential between you and your buyer agent. However, our state laws require your buyer agent to disclose to the seller or the seller’s agent any material facts about your ability to complete the transaction.

Accounting - Reporting where any monies place in the the hands of the broker or escrow agent are kept and careful administration of monies or property placed in the care of the agent.

Reasonable Skill and Care - Negotiation for a reasonable purchase price. Affirmatively discovering material facts and disclosing them to the buyer. Investigating, when possible, the important information related to the purchase decision and process.

To answer the other frequent question, "Why can't I call the name on the sign?" Let me explain. The listing agent (name on the sign) has gone under a listing contract in most instances to represent the Seller. Many assume that they can obtain a better financial deal working with the Seller's Agent. The Seller and Seller's Agent enter into a listing agreement that spells out the amount of commission the Seller(s) are willint to pay to sell the house. Whether the Seller's Agent sells the home themself and collects the full commission or cooperates with your Buyer's Agent and splits the commission, the agreed commission remains the same with the Seller. Why not be represented?

Remember, unless you agree to other terms in writing with an agent, Buyer's Agency costs you nothing.

Q. We have just bought our first brand new home, but we have a few issues that need to be completed by the builder. How should we go about getting those items addressed?

A. In order to schedule repairs, most builders require these items to be in writing. Use the following guidelines to make the most of the communication.

• Familiarize yourself with your home warranty coverage. Follow the procedure for making claims as stated in the written warranty. Some builders handle the warranty repairs themselves, while others contract with home warranty companies to handle all warranty claims. Some items, such as appliances, are usually covered by a manufacturer’s warranty, and are not the responsibility of the builder. If a problem develops after the express warranty has expired, the builder may not be required to respond under the terms of the written warranty. It is important to know what your builder's policy and procedures are before you enter into a contract to purchase a home built by them. Most builders have a timeline for you to follow giving you an opportunity to live in the home for a period of time. This allows you to discover any issues that need to be addressed that might not have been noticed at the time of your final walk-through. The builder will also want a list, also called a punch list, so they may take care of any items at the same time rather than coming out multiple times.

• Write your letter. Include the date of the request, your name, contact details, and the date you moved in. Include all relevant details. State exactly what you want done and how soon you expect it to be resolved. Include all relevant documents and photos regarding the problem, and send copies, not originals. Keep a copy of the letter for your files.

• After you alert your builder to the problem, provide them an opportunity to inspect and correct the problem within a reasonable period of time.

Homebuyer Tax Credit Expires TODAY!

No, this is not a last minute call to action. Personally, I am glad that it is over. I am happy for those that found homes they love and can benefit from the tax credit. I am, however, most happy for those buyers who disciplined themselves for their situation to not just buy any house to get a credit but to wait and find the home that best fit their needs! For some, it was easy to find a great house and reap the benefit of the tax credit. For others, not so easy. After all, it is one of the largest financial decisions you will make in your lifetime.

For now, I am ready for Sellers and Buyers to go back to a "normal" real estate market. When I figure out what a "normal" real estate market is I will be quick to let you know. In the meantime, we will work with our clients to best educate them for that important decision in "today's" market. Whatever that may be!

The Sellers who took advantage of the tax credit were able to benefit this Spring. Particularly those whose price range was around $150,000 and under. What do I mean by that? Good homes have flown off the shelf at competitive pricing as inventory has dwindled. Buyers have rushed to meet the tax credit deadline. The flip side of the Buyer's tax credit is that it was of benefit to Sellers whether they qualified for the credit themselves or not when they purchased their next home (move up or move down). They have received quicker contracts and higher pricing! Definitely good news!

There are still 18 more days to put a home under contract. The deadline to be under contract is April 30th! If you're on the fence, there is still time to get off!

Is Our Local Market Favoring Buyers or Sellers?

Who exactly has the edge in our local market? Buyers or Sellers?

The supply calculation is determined by taking the Inventory (number of homes on the market) and dividing it by the 12 Month Average of the Number of Sales. A balanced market, in general, is a 5 to 6 months supply of homes on the market. If the supply exceeds 6 months, the market can favor buyers. If the supply is less than 6 months the market can favor sellers. The supply for new and used homes in the Kansas City Region is 6.7 months of supply. This number slightly favors buyers in our area. As we teter at around 6 months of inventory we are experiencing a more balanced market for buyers and sellers. That's the good news!

Other market factors will affect our market in the coming months due to the changes in FHA financing and anticipation of rising interest rates later in the year.

Spring is around the corner and regardless of the market, is consistently and historically a GREAT time to list your home and to buy a home.

What Do You Need To Know About Deck Safety Before Buying A Home?

Deck safety is extremely important!

When you are purchasing a home your home inspector will inspect it thoroughly. They will check the railings and bannisters for stability. The railings should be at least 36 inches high and rails should be no more than 4 inches apart. They will check under the deck to check the ledger boards, support posts and joist hangers. The inspector will also be on the lookout for wood rot.

If you have a deck on your own house, it's a good idea to have it inspected annually to make sure it's structurally sound.

It Takes 21 Days To Form A Habit

I received a great tip yesterday that I want to share from one of my favorite trainers and coach, Mr. Rick DeLuca.

He provided a tip on a great website called habitforge.com. This website lets you set up your goal or goals with a daily reminder for consistency. It takes 21 days to form a habit. Once you've set up your account, which is FREE by the way, you enter your goal. Habitforge.com will send you a daily email for 21 days asking you, "Were you successful yesterday at _________________?"

Do that one thing you've committed to doing. Skip a day before succeeding for 21 days straight, and they will start you back at day one. Succeed for 21 days in a row, and you can enter monitoring mode. But by that point the action should seem second nature.

Seven Don'ts of Mortgage Funding

Once you've applied for your home loan you must comply with the Seven Don'ts of Mortgage Funding. Any of which could delay or keep you from closing on your new home.

1. DON'T change your employment status.

Probably the biggest mistake is looking at homes that you can’t afford. You could end up buying a house that you really can’t afford. You’ll need to figure in all the extras like utilities, homeowner fees and taxes. Or you could feel a little let down in what you can afford. You need to be realistic.

Another big mistake is not planning for your future. What are your needs for the next 5-10 years? Is the house large enough? Also, think about the location. Is the house located in a good school district? (Always a plus.) Does it have amenities nearby? Is the area relatively quiet? Do you like the neighborhood and neighbors?

When you’re looking at houses, make sure you look at several of them. Don’t buy on impulse. Take time to really look at the houses, and evaluate the properties before making an offer.

Housing affordability condition remains extremely favorable. NAR’s Housing Affordability Index, while declining modestly in June, was still the sixth-highest index on record dating back to 1970. Sales of existing homes trended upward for the fourth straight month, benefiting from favorable affordability conditions. The $8,000 tax credit continued to draw in first-time buyers, who accounted for 29% of all transactions in May. Repeat buyers, who often sell their current house to first time buyers, are also coming back to the market in large numbers.

Plan to take your family (and your pets if possible) away during showings. It can be uncomfortable for you and potential buyers if you’re there, which could result in a “no sale” for you.

Lock-up, or put in a safe-deposit box, any valuables (jewelry, cash, private financial information), while you are away from the house.

Before the house is shown, make sure the home is clean and neat. Open all the blinds and shades, and turn on lights if you have dark rooms or corners. Make sure the kitchen and counters are sparkling clean and all dishes are put away.

Store children’s toys in organized boxes and keep big items like bicycles, wagons, skateboards, basketball hoops put away. Keep the house as clean as possible and remove all clutter. If need be, box up any clutter and store it off-site.

Are buyers mostly young families, retirees, or singles?

Ask a real estate agent for areas showing the greatest short-term growth and other positive features, such as neighborhood amenities, average annual price increases, and available parks and recreation.

Look at potential houses that need inexpensive repairs: new paint, new carpet and tile, skylights, new appliances, and updated landscaping. Q. Are Rent-To-Own Homes A Good Idea?

A. If you’re interested in owning a home, but you’re having some difficulty obtaining conventional financing, renting a home with the option to buy may be a good alternative. In this scenario, a portion of your rent goes toward the purchase of the home. It’s important to carefully read the contract, and consult an attorney if you have any questions or concerns before entering into a contract.

Typically, you will sign a lease with an option to purchase for an agreed price over a specific time (1-2 year lease, at which time you’ll need to obtain financing from a lender). To acquire the option, the renter/buyer pays a one time, non-refundable fee, called the option consideration (2-7% of the purchase price). A percentage of all your rent payments (at least 50%) should be applied toward the purchase of the home. Rent payment must be on-time; otherwise it won’t count towards the purchase price.
You’ll be required to handle most of the home maintenance. Make sure you have the house inspected by a professional before entering into a contract.

January's Real Estate Corner Question:

Q. I’m looking for a larger house and will be selling my current home. I keep seeing “Value-Range Pricing.” I’m confused. What is Value-Range Pricing, and what should I know about it?

A. Value-Range Pricing is a relatively new pricing strategy that is popular in some parts of the country. Typically, most houses are sold when the seller lists their home with a fixed price based on an analysis of similar properties in the area.

Some real estate agents now use Value-Range Pricing as a marketing strategy when selling a home. Instead of a fixed price, a house is listed within a particular price range. For example, a range price of $260,000 to $290,000 would bring in more potential buyers (and potentially more offers) than a fixed price listing.

There are additional terms that can be negotiated beyond the price: closing dates, costs, home warranties, or title insurance. One word of caution: homes that are Value-Range Priced don’t necessarily sell more quickly, or at a higher price, than fixed priced homes.

What is Appraised Value?

· Appraisals provide an objective opinion of value, but it’s not an exact science so appraisals may differ.

· For buying and selling purposes, appraisals are usually based on market value — what the property could probably be sold for. Other types of value include insurance value, replacement value, and assessed value for property tax purposes.

· Appraised value is not a constant number. Changes in market conditions can dramatically alter appraised value.

· Appraised value doesn’t take into account special considerations, like the need to sell rapidly.

· Lenders usually use either the appraised value or the sale price, whichever is less, to determine the amount of the mortgage they will offer.

Three Ways to Make Your Home Look More Luxurious

Q. I’d like to do a makeover on my house and make it the look more luxurious, but I don’t have a lot of money to spend. What do you suggest?

1) You can make your home look more luxurious with a fresh coat of paint and a little bit of creativity. Try the new faux treatments and other new painting techniques. Your local home improvement store-brand paint usually runs about $30 per 5 gallons. Give your kitchen cabinets a clean, quick makeover by applying a coat of flat primer. After it dries apply a top coat of semi-gloss latex enamel.

Another trick: add crown molding where the wall meets the ceiling for a elegant style. Kits are available at home improvement stores.

2) Ceramic tile flooring can add luxury to your entryways, kitchens and bathrooms for $2-3 per sq. ft. If you’re handy, you can do the work yourself; otherwise installation is usually $2.50-3.50 per sq. ft.

3) New overhead lighting fixtures can change the look of a room and create a luxurious ambiance. Shop for off brands or contractor packs at home improvement stores that’ll save you money.

We are new fans of Brookside Barkery

Bath day for Braxton, our chocolate lab, is most often a calculated and planned event. While he is definitely a good sport about "bath day", it is in two words...a mess. Lots of preparation and lots more cleanup. We recently learned of Brookside Barkery with a convenient location in Lee's Summit with a great pet wash for do-it-yourselfers like us. For a minimal charge (we think so anyway) you can take your furry friend in for an almost spa like experience. You have all the tools and amenities for a pampered bath which includes a variety of shampoos and a conditioner, of course. Their are ear cleaners, nail clippers, assorted brushes, a drying station and a variety of perfumes in which to choose from. I'm sure there was more things we could have done for his additional beauty and enjoyment, but it was our first trip. The employees were terrific and very helpful. We will definitely be back for not only Braxton's next bath, but maybe a little "treat" shopping for our "boy"!

Take The Stress Out of Home Buying

Buying a home should be fun, not stressful. As you look for your dream home, keep in mind these tips for making the process as peaceful as possible.

1. Find a real estate agent who you connect with. Home buying is not only a big financial commitment, but also an emotional one. It’s critical that the REALTOR® you chose is both highly skilled and a good fit with your personality.

2. Remember, there’s no “right” time to buy, just as there’s no perfect time to sell. If you find a home now, don’t try to second-guess interest rates or the housing market by waiting longer — you risk losing out on the home of your dreams. The housing market usually doesn’t change fast enough to make that much difference in price, and a good home won’t stay on the market long.

3. Don’t ask for too many opinions. It’s natural to want reassurance for such a big decision, but too many ideas from too many people will make it much harder to make a decision. Focus on the wants and needs of your immediate family — the people who will be living in the home.

4. Accept that no house is ever perfect. If it’s in the right location, the yard may be a bit smaller than you had hoped. The kitchen may be perfect, but the roof needs repair. Make a list of your top priorities and focus in on things that are most important to you. Let the minor ones go.

5. Don’t try to be a killer negotiator. Negotiation is definitely a part of the real estate process, but trying to “win” by getting an extra-low price or by refusing to budge on your offer may cost you the home you love. Negotiation is give and take.

6. Remember your home doesn’t exist in a vacuum. Don’t get so caught up in the physical aspects of the house itself — room size, kitchen, etc. — that you forget about important issues as noise level, location to amenities, and other aspects that also have a big impact on your quality of life.

7. Plan ahead. Don’t wait until you’ve found a home and made an offer to get approved for a mortgage, investigate home insurance, and consider a schedule for moving. Presenting an offer contingent on a lot of unresolved issues will make your bid much less attractive to sellers.

8. Factor in maintenance and repair costs in your post-home buying budget. Even if you buy a new home, there will be costs. Don’t leave yourself short and let your home deteriorate.

9. Accept that a little buyer’s remorse is inevitable and will probably pass. Buying a home, especially for the first time, is a big financial commitment. But it also yields big benefits. Don’t lose sight of why you wanted to buy a home and what made you fall in love with the property you purchased.

10. Choose a home first because you love it; then think about appreciation. While U.S. homes have appreciated an average of 5.4 percent annually over from 1998 to 2002, a home’s most important role is to serve as a comfortable, safe place to live.

I received an email today from Dr. Deborah Kern. I felt compelled to share it. She writes, "In what was simply a passing remark, Tim Cook, the minister of our church, made a very powerful comment that quickened my pulse and opened my heart. He said, "There is a technology for abundance. It is 'LPG'.

LPG? Yes, that's what he said.

Then he continued to say the technology of abundance is Love, Praise and Gratitude. Love magnetizes abundance. Praise magnifies abundance. And Gratitude opens us to receive abundance.

As I heard his words, every cell in my body responded to the truth of them. Whether it is abundance in friendship or love or health or money or experiences, LPG works!

The opposite of Love, Praise and Gratitude is Fear, Criticism and Entitlement. Fear pushes abundance away from us and magnetizes the very thing we fear. Criticism shrinks and constricts abundance. And Entitlement closes us off from receiving abundance."

Thinking About Putting Your Home On the Market?

Try some of these tips before you list:

1. Have a pre-sale home inspection. Be proactive by arranging for a pre-sale home inspection. An inspector will be able to give you a good indication of the trouble areas that will stand out to potential buyers, and you’ll be able to make repairs before open houses begin.

2. Organize and clean. Pare down clutter and pack up your least-used items, such as large blenders and other kitchen tools, out-of-season clothes, toys, and exercise equipment. Store items off-site or in boxes neatly arranged in the garage or basement. Clean the windows, carpets, walls, lighting fixtures, and baseboards to make the house shine.

3. Get replacement estimates. Do you have big-ticket items that are worn our or will need to be replaced soon, such your roof or carpeting? Get estimates on how much it would cost to replace them, even if you don’t plan to do it yourself. The figures will help buyers determine if they can afford the home, and will be handy when negotiations begin. You'll also know if buyers are over estimating those items when negotiating price with you.

4. Find your warranties. Gather up the warranties, guarantees, and user manuals for the furnace, washer and dryer, dishwasher, and any other items that will remain with the house.

5. Spruce up the curb appeal. Pretend you’re a buyer and stand outside of your home. As you approach the front door, what is your impression of the property? Do the lawn and bushes look neatly manicured? Is the address clearly visible? Are pretty flowers or plants framing the entrance? Is the walkway free from cracks and impediments?

Preparation is key and the wisest decision you can make. It will most certainly effect the end result!

How To Get An Offer On Your Home

1. Price it right. Set a price at the lower end of your property’s realistic price range.

2. Prepare for visitors. Get your house market ready at least two weeks before you begin showing it. See Simple Tips For Better Home Showings.

3. Be flexible about showings. It’s often disruptive to have a house ready to show at the spur of the moment. But the more amenable you can be about letting people see your home, the sooner you’ll find a buyer.

4. Anticipate the offers. Decide in advance what price and terms you’ll find acceptable.

5. Don’t refuse to drop the price. If your home has been on the market for more than 30 days without an offer, you should be prepared to at least consider lowering your asking price. We can help you determine from your market area and its activity if it’s time.

Are We Almost There?

As a child, I would ask my parents on a road trip, "Are we almost there?". Don't tell Kevin I admitted to this, but I still do it to him. I'm not a good car rider. The Presidential Election has felt much the same way for me as I know it has for many others. Are we almost there? Thankfully the answer is yes. There has been a great deal of concern and even some fear over the economy, the housing market, job stability and so much more. I think most of us will feel a sense of relief on November 5th. Regardless of who are nation elects as the next President, we can finally move on. Many of us also are asking, "Are we almost there?" when it comes to our home prices. I don't know that anyone can quite answer that question. We probably will not know the answer until we have passed it and see obvious signs of recovery. I can tell you that we are seeing signs of improvement in the Kansas City area. You can follow our Market Watch report that we post monthly on our website to keep track.
